Landlord Electrical Safety in 2026: What Eltham Landlords Need to Know

If you're a private landlord in Eltham or anywhere in England, electrical safety compliance is a legal obligation — not optional. The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 set out clear requirements that every landlord must meet. Here's what those requirements mean in practice in 2026.

The Core Requirement: 5-Year EICR

All private landlords in England must have the electrical installations in their rental properties inspected and tested at least every five years by a qualified and competent person. The result of this inspection is an Electrical Installation Condition Report (EICR).

Key landlord obligations at a glance:

  • EICR must be carried out every 5 years (or at change of tenancy if sooner)
  • A copy of the EICR must be provided to existing tenants within 28 days
  • New tenants must receive a copy before they move in
  • A copy must be provided to the local authority if requested within 7 days
  • Any remedial works identified must be completed within 28 days
  • Evidence of remedial works must be provided to tenants and local authority

What Happens If the EICR Is Unsatisfactory?

If the EICR contains C1 or C2 observations (Danger Present or Potentially Dangerous), the report will be issued as Unsatisfactory. The landlord must arrange for all necessary remedial works to be completed within 28 days of the inspection — or sooner if the report specifies. Evidence of completion must then be provided to tenants within 28 days of the works being completed.

Where a C1 is found, it is strongly advisable not to allow tenant occupation until the danger is resolved and a satisfactory certificate is issued.

What Are the Penalties for Non-Compliance?

Local authorities have the power to issue a remedial notice where a landlord has not complied. If a landlord fails to act on a remedial notice, the local authority can arrange the work itself and recover the cost. In addition, a financial penalty of up to £30,000 can be imposed on landlords who fail to comply with the regulations.

Smoke and Carbon Monoxide Alarms

Separate from the EICR requirements, the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 require landlords in England to:

  • Fit at least one smoke alarm on every storey of the property used as living accommodation
  • Fit a carbon monoxide alarm in any room with a fixed combustion appliance (including gas boilers)
  • Ensure alarms are in working order at the start of each tenancy

Practical Advice for Eltham Landlords

In our experience working with Eltham and SE9 landlords, the properties most likely to have EICR issues are Victorian and Edwardian terraces where the original or 1970s wiring has never been properly replaced. Common findings include missing RCD protection, deteriorated rubber insulation, old rewirable fuse boards and inadequate earthing arrangements. None of these are unusual and all are fixable.

The practical approach is to get an EICR carried out well before your five-year deadline — not at the last minute when a new tenancy is imminent. If remedial works are needed, a 28-day window is achievable, but it helps to have some flexibility.
